General Terms and Conditions of Sale

Anyone practicing with PIUMA must respect the instructor and fellow students. For any musculoskeletal, lower back pain, or pregnancy-related issues and health problems, a medical certificate will be required, and you must ensure that the instructor is aware of your physical condition before the start of the class.


Dress Code

Anyone enrolled with PIUMA must wear clean attire specifically designed for Pilates, Yoga, Barre, and Classical Dance (gym pants, shorts, T-shirt, socks, or leotard, tights, and ballet slippers or pointe shoes) for group, solo, duo, and trio classes.


Classes

Pilates, Yoga, Barre, and Classical Dance classes have a duration of 55 minutes. It is advisable to arrive or log in a few minutes early. All classes must be reserved in advance, including group classes through the provided link. All classes must be paid for in advance.

For virtual classes, internet connection costs, and other telecommunications-related expenses are entirely your responsibility.


Cancellation

The schedules for group classes are non-contractual and subject to change or cancellation. A reserved class must be canceled at least 24 hours in advance to avoid charges. In case of absence, no rescheduling or makeup classes will be offered, even within a package.

Packages

Any purchased package is non-refundable. All packages are valid for 6 months. Packages must be paid in one lump sum, regardless of your payment method.

The Client acknowledges having read and accepted the General Sales Conditions, Access Conditions, and Legal Notices of PIUMA. The Client must also be aware of and comply with the Code of Conduct published by PIUMA. CAU

Both of these documents will be provided to you upon registration.

CAU

The client agrees to the Sales Conditions for Classes and Packages, as well as the Legal Notices and Access and Usage Conditions governing the contractual relationship between themselves (natural or legal person) and PIUMA.

The site accessible at the address www.piuma.fr (hereinafter referred to as the “Site”) is intended for the personal information of Internet users who use it. Access to and use of this site are subject to the “Access and Usage Conditions” (hereinafter referred to as CAU) detailed below. Logging in and accessing the site www.piuma.fr implies the complete and unconditional acceptance of all the provisions of the CAU by the Internet user.

The Client of the site www.piuma.fr declares that they have the competence and means necessary to subscribe to and access the services offered by PIUMA.

Glossary

PIUMA: a legal entity providing group or private classes, whether virtual or in person, for Pilates and Classical Dance.

Client: a user of the site and/or member of PIUMA.

Packages: refer to the products sold for accessing Pilates, Yoga, Barre, and Classical Dance workshops and classes (online or in person).

Packages are purchased after contacting Armelle Daoudal (telephone or video interview). A quote is then sent to you by email. If you accept it, PIUMA will issue an invoice that must be paid in one lump sum via bank transfer to Armelle Daoudal or through Paypal before starting classes.

RESPONSIBILITIES

The user has the power to accept the CAU and assume the obligations that arise from it. Therefore, the user uses the Site under their sole and complete responsibility and undertakes to comply with the provisions herein, the rules governing activities on the Site, and all laws and regulations applicable to the user’s activities on the Site, through it, or related to it.

The materials provided by the user and the Client’s participation in virtual classes (content or any other element provided, recorded, made available to PIUMA, or accessible through the Site) must not: contain viruses, spyware that can damage the Site, slow down its operation, or more generally, harm its proper functioning; be misleading, inaccurate, or deceptive; be acquired through illegal means or violate the rights of a third party; violate applicable codes and laws; contain elements of harassment, harmful elements, defamatory, violent, vulgar, obscene, hateful, or objectionable from a racial or ethnic perspective or contrary to good manners, or likely to violate the respect for human dignity and the protection of minors, or harm the internal and external brand image of PIUMA. The information and services accessible via the Site are provided as is. Errors or omissions may occur. PIUMA provides no warranties, express or implied, and assumes no responsibility for the use of this information, services, or the Site. The user acknowledges that they are solely responsible for using the Site and the information accessible via the Site, and they acknowledge that PIUMA cannot be held responsible for direct or indirect damages, including material damage, immaterial damage, data or program loss, financial damage, resulting from access or use of the Site or any sites linked to it, or due to interruption, suspension, modification, or discontinuation of the Site or its components. The Site’s content is presented without any warranties of any kind, as the user expressly acknowledges.

PIUMA may, in view of the circumstances, take all measures it deems necessary or appropriate regarding, on the one hand, user access and/or use of the Site, and, on the other hand, the materials provided by the user. In particular, PIUMA may interrupt, restrict, suspend, prohibit, in whole or in part, access to the Site and its virtual and in-person classes, without prior notice or compensation, if the user engages in behavior or activities prohibited by applicable laws and regulations or the CAU. The provisions of this article remain applicable after the termination or expiration of the CAU.

On one hand, PIUMA is committed to organizing group classes and occasional workshops in a clean and well-maintained studio, as well as the potentially loaned equipment. PIUMA guarantees that its instructor holds a state diploma for teaching classical dance and a certification for teaching Pilates. Additionally, PIUMA has comprehensive insurance to address accidents or disputes. On the other hand, the Client must ensure that their physical condition allows them to participate in classes provided by PIUMA. The Client undertakes to adhere to the internal rules issued by PIUMA. In the event of non-compliance with the internal rules, PIUMA disclaims any responsibility. In accordance with the internal rules, the Client must provide a medical certificate confirming their ability to engage in physical activities. If the Client has a compromised physical condition, a disability, or injuries, they must inform PIUMA and the instructor before the class.

CONFIDENTIALITY

We collect information when you register with PIUMA. When you register, we may ask for your name, gender, date of birth, email address, mailing address, postal code, phone number, and language. However, you can visit our site anonymously.

We may use the information we collect when you register: To learn more about the internet users and clients who visit the site and offer you customized features, promotions, and other notifications. We take reasonable measures to protect the data of registered members in our database. Unauthorized access or use, hardware or software failures, and other factors can compromise the security of member data at any time. We do not sell, market, or otherwise transfer your identifiable information to third parties without your prior consent. However, we retain your data. PIUMA places significant value on the security and privacy of your personal information and has procedures and policies in place similar to this to ensure the protection of your privacy. We may also disclose your information when required to comply with legal requirements. To delete all your information from our databases, you can send us an email through our contact page requesting such deletion.

If we decide to change our privacy policy, we will publish the modifications on this page. Changes to our privacy policy will apply only to information collected from the date of the modification.

The Site is provided for your information and private use.

PIUMA cannot be held responsible for any indirect damage resulting from your use of the Site (including, but not limited to, data loss, customer or business loss, missed opportunities, damage to reputation) or your inability to access it or its contents, your use of the elements contained on the Site, any failure, error, or interruption of the Site.

Furthermore, PIUMA cannot be held responsible for the consequences resulting from your violation of these CGUs. Therefore, you agree to indemnify PIUMA in the event of action taken by third parties or a conviction of PIUMA resulting from your actions.

We have included hyperlinks on the Site that lead to third-party websites. As we have no control over these sites, we cannot guarantee their availability or be responsible for the content or other elements found on these third-party sites or any transactions you may engage in on these third-party sites.

PURCHASES

The packages available on the website allow you to access group and private lessons, both online and in-person, provided by PIUMA, within the limits of the courses available on your card and the duration of your package. You can book lessons following the purchase of a package directly with PIUMA. You can buy lessons and/or packages using the accepted payment methods (bank transfer to Armelle Daoudal, as well as via PayPal). When purchasing lessons and/or packages, you certify that the billing information provided is accurate. (Please note that we do not accept payment by check.)

The prices of the Lessons and Packages are those in effect at the time of your purchase. They are indicated in euros and include all taxes (VAT, and any other applicable taxes at the time of the Order), unless otherwise stated.

PIUMA reserves the right to change its prices at any time, but your package is billed based on the rate in effect at the time of your purchase.

In accordance with the provisions of Article L121-21-8 paragraph 13 of the Consumer Code, you are expressly informed that by making a purchase of Lessons or a Package, you agree that the execution of the contract begins at the time of your purchase, and consequently, you expressly waive your right of withdrawal.

CANCELLATION

PIUMA reserves the right to change or cancel lessons and schedules, even at the last minute, due to an insufficient number of registrants or the absence of the instructor.

In this case, the lesson will not be deducted. The Client can cancel their reservation up to 24 hours before the lesson time; otherwise, the lesson will be deducted from their package and due.

In case of absence, no rescheduling or makeup will be accepted, even for Packages.

REFUND 

Purchases of Lessons and Packages are non-refundable and expire after 6 months from the date of purchase. At our discretion, we may allow you to reschedule unused lessons, subject to a maximum limit that can be subject to such rescheduling.

FINAL PROVISIONS

The fact that PIUMA does not enforce any of the provisions of these GTCS at any given time and/or tolerates a breach of any of the obligations referred to in these GTCS cannot be interpreted as PIUMA waiving its right to subsequently enforce any of these provisions.

If one or more provisions of these GTCS are held to be invalid or declared as such in accordance with a law, regulation, or following a final decision of a competent court, the other provisions shall remain in full force and effect. PIUMA may, if necessary, replace the invalid provision(s) with a new provision.

The headings of the articles of these GTCS are for reference purposes only and should not be considered to have any legal significance.
